Terms and Conditions

Scope

Business processing and delivery take place exclusively in accordance with the present general terms and conditions, which form the basis of the offers from my online shop lumeapaperandfolk.com and contracts concluded in the shop.

If "Client" are mentioned in these general terms and conditions, these are natural persons whose purpose of an order cannot be attributed to a commercial, independent or freelance activity, but also legal persons or legal partnerships that are used for commercial, independent or freelance purposes to order.

If deadlines are given in working days, these are all weekdays with the exception of Saturdays, Sundays and public holidays.

Recognition

By placing your order, you acknowledge all points of these general terms and conditions, which apply exclusively. Lumea Paper & Folk does not recognize any deviating contractual conditions. With an order, the buyer accepts all points of these terms and conditions.

Conclusion of the contract

All offers are non-binding. If the client places an oral, written or electronic order for products, the client makes a binding offer to conclude a purchase contract. 
A legally binding purchase contract is concluded when the order confirmation is sent in writing or electronically by Lumea Paper & Folk or delivery. If a product is no longer available or can no longer be delivered, Lumea Paper & Folk can withdraw from the contract in whole or in part without compensation. Payments already made will be refunded.


Lumea Paper & Folk is not obliged to accept orders if the client has outstanding payments from previous purchases or if his account is debited with legal enforcement measures. If the client's outstanding payment is only discovered after the conclusion of the purchase contract, Lumea Paper & Folk has the right to withdraw from the contract at any time and without any compensation and to invoice deliveries and services already provided.

Prices and Payment

The prices are in CHF excl. VAT. Transport and packaging costs are added at checkout but not included in the price, unless other conditions are specified. Lumea Paper & Folk reserves the right to adjust prices and / or make price errors at any time. 
The payment is possible via Credit Card (Visa, Mastercard) or via Bank Transfer.

Processing Orders

All orders that are placed on our website are processed within a week unless otherwise stated in the confirmation email and shipped from Basel, Switzerland with Swiss Mail without tracking number. Once your order is shipped you will receive a shipping confirmation email.

Delivery times are given as precisely as possible. However, these are based on experience and are non-binding. Delivery dates can change under certain circumstances. 
In no case do delays in delivery justify claims for damages or a right to withdraw from the contract.

Estimated Times

  • Domestic (Switzerland): 1-2 business days

  • Europe: 4-8 business days

  • Other countries: 4-15 business days

Returns and Exchanges

Returns and returns of goods are possible within 14 days of receipt of the goods without giving reasons. The goods must be returned to Lumea Paper & Folk in their original, undamaged packaging. Returns can only be made if the goods are in perfect condition and as good as new. A receipt or a copy of the invoice must be enclosed. 

Custom ordered items and quantities, are excluded from the right of return.

In the case of returns of parcels and freight forwarded goods, they are returned at the customer's expense and risk. Please contact us for exact return address by filling in the Contact Form or at hello@lumeapaperandfolk.com.

Export and Import Regulations

Each Party acknowledges its respective obligation to comply fully with applicable Export and Import Control Regulations in connection with the performance of this agreement. Please be aware that when purchasing to a country other than Switzerland, local taxes may be applied during import in the recipients country. The responsibility of which falls to the recipient.

Dimensions and illustrations
All dimensions, weights, information and images of our products are non-binding. The description, technical information and prices of the products can be changed at any time. We reserve the right to make changes to models, typographical or graphical errors, errors in product descriptions, prices and technical information.

Nature of Product

All goods in Lumea Paper & Folk are made by hand, which may result in slight variations, including, but not limited to paper dimensions, colors, texture, positioning, embellishments. Colors will appear differently on-screen than the actual paper color or printed design. Paper making and paper coloring are all manual processes and the colors, shapes, sizes and impressions may vary slightly between sheets and differ slightly from the samples in the studio. Colors are adjusted by eye and Lumea  Paper & Folk will color match as closely as we can to a pantone or agreed digital color, but there may be slight variation. Lumea Paper & Folk strives to accurately display the goods, however these differences can occasionally occur and do not constitute a fault or refund.

Copyright, Permissions and Ownership

Lumea Paper & Folk owns the copyright to all designs, drawings, sketches, artwork, photography, typography, paper crafting and paper goods created by Lumea Paper & Folk, including custom creations for Client, and the foregoing may not be reproduced by the Client or any third party without the express and written permission of Lumea Paper & Folk.

Lumea Paper & Folk retains the right to keep samples and photograph all designs and paper goods and to use samples and photographs for promotional purposes, publication, marketing and educational purposes. Copyright notice in the name of Lumea Paper & Folk shall accompany the goods when displayed whether printed or online, such as in magazines, websites and blogs.

It is the responsibility of the Client to ensure that all material the Client provides to Lumea Paper & Folk to work with is owned by the Client, or the Client has the correct copyright permissions from the copyright owner to reproduce it. Lumea Paper & Folk will not be held responsible for copyright infringement and any claims for costs and/or expenses arising from such infringement.

Lumea Paper & Folk respects the work of other designers, stationery makers and handmade paper crafters. We are excited to review your paper inspirations however Lumea Paper & Folk will not copy another designer’s work.

If a custom project is cancelled prior to the completion of the final stage the Client shall not be entitled to exploit the ideas, designs or other information made known to the Client by Lumea Paper & Folk in relation to the project. The fees for the project have been based on the understanding that the designs shall be used only for the purpose specified.

Redeeming discount coupons

Lumea Paper and Folk may issue discount coupons. These coupons may require a minimum order value. This will be indicated on the coupon itself. Discount coupons may not be combined. This means that only one coupon may be redeemed per purchase.

Changes

Lumea Paper & Folk is entitled to change its general terms and conditions at any time by notifying the buyer or publishing them on the website.

Terms and Conditions for Custom orders 

1. Costs and payment

A non-refundable deposit of 50% of the quotation is required for work to begin, and upon the signing of this agreement. Client agrees to a payment schedule as follows:

     - A non-refundable deposit of 50% of the quotation: payment due upon the signing of the agreement

     - Remaining balance due before delivery of goods: an invoice will be submitted for payment of the balance prior to the delivery of the goods

 

Both a signed agreement and the non-refundable initial payment must be received by Lumea Paper & Folk in order to start the execution of the services. If goods are to be shipped to Client, final payment for any outstanding balance of the costs must be received by Lumea Paper & Folk prior shipping.

 

If there is a need to cancel your order, please contact Lumea Paper & Folk right away. If the final approval has not been received and the projects has not gone into production phase, Client is responsible for the deposit and any materials that have been purchased. If the project has gone in a production phase Client is responsible for the entire amount as stated in this agreement. Because of the personalization of the stationery, orders are non-refundable, without exception.

Orders may be considered RUSH if they are needed within a 4-week turnaround. Rush orders are accepted depending on availability and the requirements of the project. Rush orders will be charged with a fee of 15% to your order total.

Shipping fees are excluded and are supported by the Client depending on the weight of the package and the delivery address. You will receive a separate invoice with shipping cost, after the package is assembled and weighted. Lumea Paper & Folk is not responsible for any damage incurred during shipping and/or mailing or stationery that is not delivered. There will be no refunds for packages purportedly missing or stolen. Lumea Paper & Folk will not be responsible in any way for packages left outside or with third parties other than Client.

2. Proofs, inspections and revisions by Client

It is the Client’s responsibility to carefully review all proofs for any error. That includes spelling, layout, website URLS, phone numbers, directions, colors, sizes etc.

Lumea Paper & Folk will submit digital proofs for Client’s approval. Whilst Lumea Paper & Folk will take all possible care in creating these, Client is responsible for checking supplied materials for content and accuracy and making comments or amends to the design if necessary. Lumea Paper & Folk will start the execution of the agreement only after receiving a written sign-off from Client referencing the correct proof to proceed with.

 

Once Client gives the final approval any errors are corrected at Client expense. After sign-off any further changes to the design or rounds of amends will cost additional feel (each) or Lumea Paper & Folk will charge for any reprinting, paper making or any other service as necessary.

 

Lumea Paper & Folk accepts no responsibility for damage to goods after it leaves our studio. This includes damage during delivery and subsequent posting. Client must inform Lumea Paper & Folk of any issues or concerns such as missing or damaged items within forty-eight (48) hours of receipt and the goods returned to us, in its entirety, packed securely so as to avoid any damage likely to be incurred during transportation. Lumea Paper & Folk shall not in any way be responsible for any issues discovered more than forty-eight (48) hours after receipt of the goods, whether or not the responsibility of Lumea Paper & Folk or due to delivery.

 

Please note, Lumea Paper & Folk cannot accept returns due to Client input or typographical errors. When the final proof is approved, Client accepts responsibility for any errors. Lumea Paper & Folk only makes refunds and exchanges if goods are faulty on the part of Lumea Paper & Folk, and we will correct or replace the goods with the same, or, if this is not possible, Lumea Paper & Folk will offer an alternative replacement. Lumea Paper & Folk will offer a refund for the amount paid to the faulty of the order, if we are unable to correct of replace the goods. Lumea Paper & Folk will only offer a full refund if the order is faulty in its entirety and we are unable to correct or replace the goods.

 

Any additions to the scope of the project described in this agreement will be considered additional services or ‘revisions’ and will be charged as such. These may include new deliverables, more complex creative or production requirements, Client changes after approval for a specific stage of work or beyond the number of amend stages outlined in this proposal, or delays in the project schedule caused by the Client.

3. The process

Following the initial consultation and preliminary discussions with Client, and once the deposit, wording and agreement approval are received, Lumea Paper & Folk will provide initial design concept for the goods.

Good proofs shall be in electronic PDF format, and it is suggested that Client print all proofs in order to review them for providing feedback to Lumea Paper & Folk.

Client is SOLELY RESPONSIBLE in order to review them for providing feedback to Lumea Paper & Folk. Client is SOLELY RESPONSIBLE for proofreading duties! Each Client is given maximum three proofs after initial consultation, throughout the design process, and it is Client’s responsibility to perform a check for accuracy of each proof with respect to all information, including but not limited to names, dates, times, locations, spelling, sizes, colors. If Client finds such errors in the final goods, Client shall be responsible for the design labor, reprinting and materials costs and fees necessary to remedy the error. Client agrees to review all proofs within the time identified for such reviews and to promptly either (a) approve the proofs, or (b) provide written comments and/or corrections to sufficiently identify Client’s concerns, objections or corrections to Lumea Paper & Folk.

All proof edits require additional proof reviews and take 2-4 days depending on the changes and the timeline will be updated if additional proofs are required. Client acknowledges and agrees that Lumea Paper & Folk's ability to meet any and all schedules is entirely dependent upon Client’s prompt performance of his/her obligations.

Each Client is given a maximum of three proofs after initial consultation, and proofs after those will be charged additionally. A final PDF digital Proof of the Designs will be sent to Client via email for approval prior printing. Client must thoroughly review the final Proofs and send to Lumea Paper & Folk written approval to print (“Final Approval”).

The estimated completion date for the goods will be specified in the agreement. Any delay in the completion of the goods due to actions of Client, including delays in communicating with Lumea Paper & Folk, failure to provide copy/wording, approval or other input regarding the goods; unusual transportation/shipping delays; unforeseen emergency of Lumea Paper & Folk; or external forces beyond the control of the Lumea Paper & Folk, shall entitle Lumea Paper & Folk to a reasonable extension of the completion/delivery date, upon notification to Client, for the amount of time necessary to remedy the delay

 Additional policies for any order

Force Majeure: No Party shall be deemed to be in breach of this agreement by reason of any delay in performing, or any failure to perform, any of its respective obligations, if the delay or failure was due to any cause beyond its reasonable control, including but not limited to acts of Gods, explosions, floods, fire or accident, war, terrorism, civil disturbance, import or export regulations or embargoes (“Force Majeure Event”). In the event of either Party being so hindered or prevented by a Force Majeure Event, such Party shall give notice of suspension as soon as reasonably possible to the other Party stating the date and extent of such suspension and the cause thereof. Any Party whose obligations have been suspended as aforesaid shall resume the performance of such obligations as soon as reasonably possible after the removal of the Force Majeure Event and shall notify the other Party hereof.

Incapacity: Should Lumea Paper & Folk become materially or physically incapacitated, such as due to injury, severe illness or unexpected circumstances prohibiting us from performing the services and goods under this agreement for any reason, complete obligation of Lumea Paper & Folk to the Client may be discharged in its entirety by the refund of initial deposit, without prejudice, and disclaiming any secondary consequences or costs that Client may incur.

Cancellation: It is in Lumea Paper & Folk's intention to bring every job to completion, but in case of a substantial reason that Lumea Paper & Folk choose not to move forward with any part of the project, a refund will be assessed and Client will be required to sign a refund form with agreed refund amount.

In the event of cancellation by Client of Lumea Paper & Folk's goods and services for any reason, after any but before the final proof sent to the Client, fifty percent (50%) of the total Costs shall be retained by Lumea Paper & Folk and Client shall be responsible for payment for the time spent on design services in excess of the amount already paid, as well as the costs for all supplies ordered.

In the event of a partial cancellation after any proofs for the cancelled item(s) have been submitted to Client (i.e. cancellation of certain items or elements specified in the agreement), fifty percent (50%) of the costs associated with the cancelled item(s) shall be retained by Lumea Paper & Folk, plus Client shall be responsible for payment for the time spent on design services for those cancelled items in excess of the amount already paid, as well as the costs for all supplies ordered for the cancelled items.

In the event of cancellation by Client of Lumea Paper & Folk's goods and services after the Client sent the approval of the final proof, meaning all goods have been placed into production process, Client must pay total amount of money to Lumea Paper & Folk.

Payment of any outstanding portion of the costs due at the time of cancellation shall be made within ten (10) days of the Client’s notification of cancellation.

Applicable Law:  Swiss law applies to these terms and conditions.

Place of Jurisdiction: All disputes arising out of or in connection with this agreement, including disputes on its conclusion, binding effect, amendment and termination, shall be exclusively resolved by the competent court of Basel (Canton of Basel Stadt / Switzerland, (CH-4051 Basel).
